Article 1Purpose
These Specific Terms set out the conditions specific to SwizCloud web hosting services. They supplement the General Terms, with which they form an indivisible whole.
Article 2Description of the service
The service provides the Customer with hosting space on servers connected to the Internet and administered by SwizCloud, managed from the Plesk panel.
The features of each plan (number of websites, disk space, databases, email accounts, free domain name, etc.) are detailed on the website at the time of ordering and form part of the contract. SwizCloud may change its plans while maintaining an equivalent or higher level of service for existing contracts.
Article 3Activation and term
The hosting is activated once payment has been validated. Activation is normally immediate and may take up to 24 hours.
The contract is concluded for the term chosen when ordering and renews automatically for the same term unless cancelled. The start and renewal dates are shown in the client area.
Article 4Use of the service
In addition to the uses prohibited by the General Terms, it is prohibited to use the web hosting as a proxy, VPN, mail relay or file storage space unrelated to a website.
Failure to comply with these rules may lead to the immediate suspension or termination of the service, without notice or refund.
Article 5Resources and limits
The Customer uses the resources of their plan within the limits of the capacity provided. Any overuse may lead to a temporary suspension until the situation is regularised, to additional invoicing or to an offer to move to a higher plan.
SwizCloud may temporarily limit or interrupt a service whose abnormal use compromises the stability or security of the infrastructure.
Article 6Backups and security
Web hosting plans include a daily backup. It is provided as an additional measure and does not guarantee that data will be kept or fully restored; the Customer keeps their own copies.
SwizCloud deploys reasonable security measures (firewall, anti-DDoS filtering, monitoring) but cannot be held liable for an intrusion or data loss caused by an external event or by the Customer’s fault.
Article 7Migration
At the Customer’s request, SwizCloud may move an existing website to its hosting free of charge. The Customer provides the necessary access and keeps a copy of their website until the transfer is complete.
Article 8Technical support
Technical support is available 24 hours a day, 7 days a week:
- by ticket from the client area;
- by email at contact@swizcloud.fr;
- through the chat on the website;
- by phone at +33 9 72 43 03 42.
It covers the services provided by SwizCloud (infrastructure, connectivity, availability, Plesk panel). It does not include developing or fixing the Customer’s websites, configuring third-party applications or training on external software. Any service outside this scope may be invoiced.
Article 9Liability
SwizCloud uses all reasonable means to ensure the proper operation, availability and security of its services. It cannot be held liable in the event of:
- temporary interruption for maintenance, updates or security;
- unavailability or slowdown caused by an external event (supplier failure, network outage, attack, force majeure);
- incorrect configuration or non-compliant use by the Customer;
- loss or alteration of data, except in the event of gross negligence directly attributable to SwizCloud.
Should its liability be established, it would be limited to the amount paid by the Customer for the current period of the service concerned.
Article 10Termination
The Customer may cancel their hosting at any time from their client area; cancellation takes effect at the end of the current period. The period already paid is not refunded, except under the 72-hour guarantee provided for by the General Terms.
SwizCloud may suspend or terminate the contract, without notice or compensation, in the event of non-payment, breach of these terms or of the General Terms, abusive or illegal use, or harm to the security of the infrastructure.
After termination, hosted data may be permanently deleted after 7 days. It is the Customer’s responsibility to retrieve it beforehand.
Article 11Final provisions
These Specific Terms supplement the General Terms of Sale and Use.
In the event of conflict, they prevail for everything relating to web hosting. For any matter they do not cover, the General Terms apply in full.
