General Terms of Sale and Use

Version of 25 October 2026

Translation provided for information only. Only the French version of this document is legally binding.

These terms are entered into between SwizCloud, operated by OSIOM AGENCY SAS, 58 rue de Monceau, CS 48756, 75380 Paris Cedex 08, France, registered with the RCS Paris 987 763 430, EU VAT number FR54 987 763 430, hereinafter “SwizCloud”,

and any natural or legal person, consumer or professional, under private or public law, who subscribes to one or more services provided by SwizCloud, hereinafter the “Customer”.

Article 1Purpose

These General Terms of Sale and Use (the “General Terms”) set out the rights and obligations of the parties for the provision and use of SwizCloud services: VPS, dedicated servers, web hosting and domain names.

SwizCloud directly hosts and provides these services. The Customer remains solely responsible for the content they host and for the use they make of the services.

SwizCloud may amend these General Terms. The new terms apply immediately to any new order and, for existing services, after prior notice to the Customer. The current version can always be consulted on this page.

Article 2Registration and access to the services

Registration is open to any adult, or to a minor with the authorisation of their legal representatives. The Customer provides accurate information and keeps it up to date. False identities and temporary email addresses are prohibited.

SwizCloud may verify a Customer’s identity. The Customer then has 48 hours to provide the requested documents, failing which their account may be suspended.

Login credentials are strictly personal and confidential.

Article 3Orders and pre-orders

The Customer orders services from the website or their client area, subject to payment being validated. Any order constitutes acceptance of these General Terms and of the Specific Terms of the service concerned.

Some services may be offered as pre-orders, with an indicative availability date. If a service becomes definitively unavailable or is excessively delayed for reasons attributable to SwizCloud, the Customer may cancel their pre-order and be refunded the amount paid.

Article 4Prices and invoicing

Prices are stated in euros, including all taxes (French VAT of 20% included). Amounts shown in another currency are indicative only: invoices are always issued in euros.

Each service is subscribed for the period chosen when ordering (monthly, annual or other) and renews automatically for the same period unless cancelled. Invoices are available in the client area.

If payment is not made by the due date, the service may be suspended, then terminated under the conditions set out in the Specific Terms.

Article 5Payment methods

Services are paid by credit card, Apple Pay, Google Pay or PayPal. The available payment methods are shown when ordering.

Payment is due immediately upon ordering, unless otherwise agreed between the parties.

Prepaid credit added to the client area is personal, non-transferable and non-refundable, including in the event of termination.

Article 6Delivery of the services

Services are delivered by being activated in the client area, after payment has been validated. The activation times specific to each service are set out in the Specific Terms.

Activation constitutes full delivery. Once the service is activated, no refund may be claimed, except under the 72-hour guarantee (article 7) or a mandatory legal provision.

Article 7Money-back guarantee

Within 72 hours of the activation of a VPS (Linux or Windows) or a web hosting plan, the Customer may request a full refund of their order, without having to give a reason. The request is made by ticket from the client area; the service is then terminated and its data deleted.

This guarantee does not apply:

  • to domain names, whose registration is final (article 8);
  • to dedicated servers;
  • to a service suspended or terminated for abuse or prohibited use (article 10).

Article 8Right of withdrawal

In accordance with articles L221-18 et seq. of the French Consumer Code, a Customer who is a consumer has fourteen (14) days from the conclusion of the contract to exercise their right of withdrawal.

By confirming their order, the Customer expressly requests that performance of the service begin before the end of this period. They acknowledge that they lose their right of withdrawal for a service fully performed before the end of the period.

Under article L221-28 of the French Consumer Code, the right of withdrawal does not apply to clearly personalised goods: the registration of a domain name, reserved in the Customer’s name, is firm, final and non-refundable.

Article 9Customer service

SwizCloud provides technical and sales support that can be reached:

  • by ticket from the client area;
  • by email at contact@swizcloud.fr;
  • through the chat on the website;
  • by phone at +33 9 72 43 03 42.

Article 10Abuse and prohibited uses

The Customer uses the services in accordance with the laws and regulations in force and with these terms. The following are prohibited in particular:

  • sending unsolicited bulk email (spam) or any similar activity;
  • phishing, distributing malware and any attempted fraud;
  • hosting or distributing illegal content or content contrary to public order (including child sexual abuse material, incitement to hatred and copyright infringement);
  • computer attacks of any kind (DDoS, scans, intrusions, exploitation of vulnerabilities);
  • cryptocurrency mining without SwizCloud’s authorisation;
  • any excessive use of resources that threatens the stability or security of the infrastructure, within the meaning of the fair use policy.

Any abuse may lead to the immediate suspension, or even termination, of the service, without notice or refund, and where applicable to legal action.

Article 11Customer obligations

The Customer is solely responsible for the content they host, transmit or publish, and for any activity carried out from their account. In particular, they undertake to:

  • comply with the laws and regulations in force and with the rights of third parties;
  • protect their credentials and not share them with third parties;
  • bear the consequences of the use they make of their services.

Article 12Backups

Some services include automatic backups. They are an additional security measure, with no guarantee of availability, integrity or complete restoration of data.

The Customer remains responsible for keeping their own data and puts in place backups suited to their needs.

Article 13Personal data

The Customer’s personal data is processed in accordance with the General Data Protection Regulation (GDPR), under the conditions described in the Privacy Policy.

Article 14Specific Terms

Each service is governed by Specific Terms that set out how it is provided, its technical limits, any availability commitment and its rules of use:

Acceptance of these General Terms constitutes acceptance of the Specific Terms of the service ordered.

Article 15Governing law and disputes

These General Terms are written in French and governed by French law.

In the event of a dispute, the parties first seek an amicable solution. Failing that, any dispute relating to their performance or interpretation falls under the exclusive jurisdiction of the courts within the jurisdiction of the Paris Court of Appeal, even in the event of multiple defendants or third-party claims, subject to the mandatory rules that protect consumers.
