Article 1Purpose
These Specific Terms set out the conditions for the registration, transfer, renewal and management of domain names by SwizCloud. They supplement the General Terms.
Article 2Description of the service
SwizCloud acts as a registrar or through accredited partners to allow the Customer to register, transfer and renew domain names, and to manage their DNS configuration.
The available extensions and their specific rules are shown on the website when ordering.
Article 3Activation and term
The registration or transfer takes effect once payment has been validated and confirmed by the registry concerned. The registration term is set when ordering, generally from 1 to 10 years.
The Customer makes sure their domain is renewed before it expires. Otherwise, the domain expires and may be deleted or made available again according to the registry’s rules.
Article 4Use of the service
The Customer is solely responsible for the use of their domain names. They do not infringe the rights of third parties (trademarks, copyright, trade names) and comply with the law and with the rules of ICANN and the registries.
Any abusive or illegal use (phishing, spam, cybersquatting, illegal content) may lead to the suspension or deletion of the domain, without compensation or refund.
Article 5Registration conditions
Registration follows the “first come, first served” rule and is only guaranteed once confirmed by the registry.
The Customer provides accurate and up-to-date information for the WHOIS directory. False, incomplete or outdated information may lead to the suspension or deletion of the domain, in accordance with the rules of ICANN and the registries.
Article 6Domain protection and management
Depending on the extension, SwizCloud offers included or optional services: WHOIS privacy (masking of personal data), DNSSEC, and locking against unauthorised transfers.
The Customer activates and maintains these services where they are available. SwizCloud cannot be held liable for the loss or transfer of a domain caused by the Customer’s negligence, the disclosure of their credentials or a decision by the registry.
Article 7Technical support
Support assists the Customer with registration, renewal, transfer, DNS configuration and activation of options. It does not cover intellectual property disputes or legal proceedings between third parties.
Article 8Liability
SwizCloud acts as an intermediary between the Customer and the registries. It cannot be held liable for the refusal or cancellation of a registration by a registry, the loss of a domain not renewed by the Customer, a suspension or deletion decided by a regulatory authority, or disputes over the choice or use of a domain.
Article 9Expiry and no refund
A domain that is not renewed expires at the end of the subscribed period. Depending on the extension, it may enter a grace period and then a redemption period, subject to additional fees, before it is permanently deleted by the registry.
In accordance with article L221-28 of the French Consumer Code, the registration of a domain name is a clearly personalised good: it is firm, final and non-refundable once the order is confirmed. It is not covered by the 72-hour guarantee.
Article 10Registry policies
The registration and use of domain names are subject to the naming rules and charters of the competent registries and authorities (ICANN, Afnic, EURid, Verisign, etc.). The Customer undertakes to comply with them; they are listed on the Legal documents page.
In the event of conflict between these terms and a registry’s policy, the registry’s rules prevail.
Article 11Final provisions
These Specific Terms supplement the General Terms of Sale and Use.
In the event of conflict, they prevail for everything relating to domain names. For any matter they do not cover, the General Terms apply in full.
